If you reside in the United States and your PII and/or PHI ("Private Information") may have been compromised in the KMJ Incident that impacted Rancho Family Medical Group, Inc. ("RFMG" or "Defendant") in November 2023 then you may be a Class Member. Excluded from the Settlement Class are: (i) the Judge presiding over this Litigation, and members of his direct family; (ii) Defendant, its subsidiaries, parent companies, successors, predecessors, and any entity in which the Defendant or its parent companies have a controlling interest and its current or formers officers and directors; and (3) Settlement Class Members who submit a valid Request for Exclusion prior to the Opt-Out Deadline.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by December 29, 2025.

The following benefits are available to Settlement Class Members:

Credit Monitoring Services: All Class Members can enroll in three (3) year of Credit Monitoring and Identity Theft Protection Services (requires enrollment by a code printed on the notification that you will receive). You do not need to submit a Claim Form to be eligible for the Credit Monitoring Services

Out-of-Pocket Expenses: If you incurred actual, documented out-of- pocket losses due to the KMJ Incident, you can get back up to $10,000.00. The losses must have occurred between November 1, 2023, and December 29, 2025. This benefit covers out-of-pocket expenses like:

  • unreimbursed losses relating to fraud or identity theft;

  • professional fees including attorneys' fees, accountants' fees, and fees for credit repair services;

  • costs associated with freezing and unfreezing your credit with any credit agency;

  • credit monitoring costs that were incurred on or after the KMJ Incident through the date of claim submission; and/or

  • miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges.

You need to send proof, like receipts or bank statements, to show how much you spent or lost. You can also send notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim.

Attested Time: Class Members who spent time responding to the Data Security Incident may claim up to four (4) hours, at $17.00 per hour, for a maximum of $68.00. You must have spent the time on tasks related to the KMJ Incident. Some examples include things like:

  • changing your passwords on potentially impacted accounts';

  • monitoring for or investigating suspicious activity on potentially impacted medical, financial or other accounts';

  • contacting a medical provider or financial institution to discuss suspicious activity;

  • signing up for identity theft or fraud monitoring; and/or

  • researching information about the KMJ Incident, its impact or how to protect themselves from harm due to the KMJ Incident.

Pro Rata Cash Payment: You may claim a payment from the Settlement Fund not to exceed $1,000.00. You do not need to submit a Claim Form to be eligible for the Pro Rata Cash Payment. However, you may submit a claim form indicting your preference as to how to receive your Pro Rata Cash Payment.

Class Members may claim for one or all of these benefits.

If a Class Member does not submit a valid and timely Claim Form, the Class Member will release his or her claims without receiving any of the above Settlement benefits.

The deadline to submit a Claim Form online is December 29, 2025. If you are mailing your Claim Form, it must be mailed with a postmark date no later than December 29, 2025.
